"content": "Thank you, Hon. Speaker. (iv) THAT, the Cabinet Secretary has breached Section 37 of the Public Procurement and Disposal Act No.15 of 2013 by refusing to undertake due diligence and non-adherence to the procurement regulations in the Laptop Programme; (v) THAT, the Cabinet Secretary has breached Section 28 of the Basic Education Act, No.14 of 2013 which requires the Cabinet Secretary to implement the right of every child to free and compulsory basic education; (vi) THAT, the Cabinet Secretary has breached Section 29 of the Basic Education Act No.14 of 2013 which provides for free tuition and that no public school shall charge or cause any parent or guardian to pay tuition fees for or on behalf of any pupil in the school; (vii) THAT, the Cabinet Secretary has breached Section 39(e) of the Basic Education Act No.14 of 2013 which compels the Government to provide infrastructure to schools yet parents and guardians are forced to pay extra fees for infrastructure; (viii) THAT, the Cabinet Secretary has breached Article 125 of the Constitution and Section 23(a) and (b) of the National Assembly (Powers and Privileges) Act Cap. 6 by failing to honour summonses of the Departmental Committee of Education, Science and Technology; and, (ix) THAT, in line with Article 129(2) and 152(4)(a) of the Constitution of Kenya, the Office of the Cabinet Secretary, being a public officer, and in accordance with Article 73 and Article 10 of the Constitution, the bearer of the office is supposed to conduct himself with utmost integrity."
