    "content": "Thank you, Temporary Deputy Chairman. I have had the opportunity to discuss this with Hon. Ochieng’. This is a matter which was canvassed in our Committee. We discussed and we found that it was in appropriate. As you know, the EACC is established under Article 79 of the Constitution which states as follows: “Parliament shall enact legislation to establish an independent ethics and anti-corruption commission, which shall be and have the status and powers of a commission under Chapter Fifteen, for purposes of ensuring compliance with, and enforcement of, the provisions of this Chapter” Article 250(12) deals with the composition and appointment of terms of independent officers. If you look at Article 250 (6) (a), it says: “A member of a commission, or the holder of an independent office- (a) Unless ex-officio, shall be appointed for a single term of six years and is not eligible for re-appointment.” You are trying to limit that term on the basis of a legislation. You are purporting to amend a Constitution which does not make constitutional sense."
