    "content": "clause− “(1) Any person or Government Ministry or other agency that plans to conduct any commercial activity other than fishing which is likely to have an adverse impact on fish and their habitat, shall apply to the Director- General in the prescribed form prior to the commencement of the planned activity with a view to ensuring the conservation and protection of such resources.”; (b) deleting sub-clause (2) and substituting therefor the following new sub- clause− “Where an application is made under subsection (1), the Director-General shall refer the matter to the National Environment Management Authority who shall give a report regarding the likely impact of such activity on the fishery resources, including their habitat, and possible means of preventing or minimizing adverse impact.”; (c) inserting the following new sub-clause immediately after sub-clause (3)− “(3A) Any report made under sub-section (2) must be completed within six months of the making of the application.”; (d) deleting sub-clause (4) and substituting therefor the following new sub- clause− “(4)Any person who violates any provisions of this section commits an offence and shall be liable on conviction to a fine not exceeding one million shillings or to imprisonment for a term not exceeding three years or to both, and in addition such person shall be liable to pay compensation in respect of any resulting loss or damage as well as the full cost of restoring the affected habitat to its previous state.” This is just to comply with the existing provisions of the law, for the Environmental Management and Coordination Act to apply when they are assessing this provision."
