Temporary Deputy Chairman, I beg to move:- THAT, Clause 28 of the Bill be amended in sub-clause (2) by inserting the words “or to imprisonment for a term not exceeding three years or both” immediately after the word “shillings.” This one is on prohibition of unauthorized use of data. the penalty that had been placed there says that a person who contravenes section 1 - which is on unauthorized use of data - commits an offence and shall be liable, on conviction, to a fine not exceeding kshs1 million so, we have gone ahead and added “or to imprisonment for a term not exceeding three years or both”. That is what we have added so that if there is any misuse of data, there is that option of imprisonment."
