"content": "Hon. Temporary Deputy Speaker, when I look at this Bill, two things come into my mind. One, I applaud the whole Part II of the Bill which is reorganising and improving the organisational and administrative structure of the Court of Appeal which is a key link in the whole judicial chain. I do not see any sense in the very rigid specific requirement in Article 14 together with Article 20 that seems to be saying that the seat of the headquarters or the centre of this court can only be in Nairobi. It would have been sufficient for Article 14 to merely provide that there shall be the office of the president of the Court of Appeal. I see absolutely no rationale to specifically legislate that that office must be in Nairobi. We are now a devolved State. The reality of devolution is that the whole country will at some point rise to levels of development infrastructurally.
