(a) Notwithstanding the fact that Mr. Kilion Oudu was acquitted by the court, he was taken through an administrative process which found him guilty of stealing 180 tins of road marking paint from the Kenya Ports Authority Container Stores. (b) Mr. Oudu collected his terminal benefits on 30th November, 2004 and will not be reinstated due to the reasons stated in “a” above. (c) Mr. Oudu was entitled to terminal benefits amounting to Kshs823,379 less tax of Kshs34,338, which left him with a net payment of Kshs789,031."
