"content": "Mr. Speaker, Sir, I rise on this point of order to raise a constitutional issue in so far as these proceedings are concerned. Article 73(1)(a) of the Constitution provides that:- Authority assigned to a State officer is a public trust to be exercised in a manner that- (i) Is consistent with the purposes and objects of this Constitution.- (ii) Demonstrates respect for the people (iii)Brings honour to the nation and dignity to the office Mr. Speaker, Sir, read with Article 181(a) of the Constitution, which provides that:- “A county governor may be removed from office on any of the following grounds: (a)Gross violation of the Constitution or any other law The Chairman of this Committee has told us that in their finding, the charge that the governor put up his portrait, giving the impression in Murang’a County that this was his private and personal industry actually took place. The Committee then went on and did something very strange; they made recommendations that there is no problem with this because all we want is for Mr. Governor to pull down those billboards. I would like the Chair for the sake of posterity, to make a determination whether this Committee was within its mandate to pretend that it had been asked to go and cure a situation. It is now on HANSARD that this Committee has proven the charge of the billboards; that these billboards were actually put in the governor’s personal name. Therefore, the Constitution in Article 73 was breached. Because the Constitution is above our Standing orders and above our own belief, for this reason, I would like it to be found and with tremendous respect that this Committee failed in its mandate."
