Temporary Deputy Chairlady, I beg to move:- THAT Clause 22 of the Bill be amended by inserting the following new paragraph immediately after paragraph (b)— “(c) include any other project undertaken pursuant to Article 187 of the Constitution.” The import of my amendment is, if we pass this law as proposed by the Chairman without these amendments, it will mean that Hon. Members will never construct a road, bridges or start a water project. However, that is against Article 187 of the Constitution which is about transfer of functions. We must allow this clause to go in so that we envisage a situation where if you have an agreement with another level of Government, you can transfer functions. So, its essence is to ensure that where you agree with the county, you can as well be allowed to do another project that falls in another level of Government as per Article 187 of the Constitution."
