The provision is in this Bill for members to serve for a term of four years, but will also be eligible for reappointment for a further term of four years. Mr. Temporary Speaker, Sir, the proposed law also empowers the Cabinet Secretary in charge of education to designate a public officer to be the Secretary to the tribunal. The Cabinet Secretary will also have powers to determine any allowances or remuneration to members of the tribunal in consultation with the Salaries and Remuneration Commission (SRC). The functions of the tribunal will be to consider appeals made against the decision of the KNEC to withhold, nullify or cancel examinations, prepared and administered by them. The tribunal has also been given the powers to summon witnesses, take evidence on oath or affirmation and order the production of any documents that they may require. Other provisions contained in this Bill will be procedures for making appeals, the manner in which any communication will be done and the timelines within such communications may be made. I am convinced that this Bill will give an avenue for redress for candidates whose results are withheld or cancelled. Those aggrieved may seek to be heard by the tribunal once this Bill is enacted into law. I appeal strongly to my colleagues in this House to support this Bill, taking into consideration the amount of damage which has been done already and the number of young people whose future has been shattered by the decisions of the KNEC, particularly when such decisions are arbitrary. Such decisions are taken arbitrarily without taking into full consideration the circumstances or even listening to the views of those affected. I feel strongly that the time has come when this amendment should be considered and passed by Members of this House. Mr. Temporary Speaker, Sir, I, therefore, strongly appeal to colleagues to consider this seriously for the sake of the future of our young people. For the benefit of those who may have been condemned without being heard, it is important to pass this particular law. I beg to move and request Sen. M. Kajwang to second."
