Speaker, when you look at Article 168(5) of the Constitution of Kenya, it says that when the Judicial Service Commission does its recommendations to the President, the President is under obligation. The words used in the Constitution read:- “(5) The President shall, within fourteen days after receiving the petition, suspend the judge from office and, acting in accordance with the recommendation of the Judicial Service Commission─ ---”"
