    "content": "Mr. Speaker, sir, I wish to respond as follows:- On 10th February, 2016 the Deputy Officer Commanding Police Station (OCS), Kilingili Police Station, and other officers were on their way back to the Station from Hamisi Law Courts aboard GKB269E, Toyota Land Cruiser, when they found a motorcycle parked dangerously on the highway at Chavakali Market, though it was not manned. The officers loaded the motorcycle, Registration No. KMDS 370U, make TVS; to their vehicle and drove to the station where it was booked in the occurrence book. Shortly thereafter, a group of four young men came to the station complaining that the motorcycle recovered by the police belonged to the chairman of the boda boda operators at Stendi Kisa Stage. They were advised to inform the owner to go personally to the police station. Mr. Speaker, Sir, the following day, the owner of the motorcycle accompanied by five of his colleagues visited the police station where they demanded for the release of the motorcycle. However, he was arrested and later charged in court. He was, however, arrested and later charged before the court vide file No.15/2016, with riding a motorcycle without insurance and causing obstruction. He was released on a cash bail of Kshs10,000. The case will be coming up for hearing on 26th April, 2016. Meanwhile, the other operators went back and requested the area Member of the County Assembly (MCA) for his intervention. The MCA drove to the police station and demanded for the unconditional release of the boda boda operator, but Officer Commanding Station (OCS) declined. The MCA proceeded to Chavakali where he held a meeting with the boda boda operators. Immediately thereafter, about 200 boda boda operators from Chavakali and Stand Kisa drove to Kilingili Police Station. The police officers blocked the riders from accessing the police station, although the crowd was very defiant and rowdy, which prompted the officers to use teargas as they strived to protect the station and prisoners. However, the rowdy riders overpowered them and forced their way into the station. In an attempt to ensure that safety of the station and the officers, the police officers shot several rounds of ammunition, which resulted to injuries of four persons who were taken to Vihiga Referral Hospital. Unfortunately, one of the victims, Victor Inonda aged 31 years succumbed to the injuries, while the rest were treated and discharged. An inquest file No.1/2016 was opened by the Vihiga County Criminal Investigation Officer and has been forwarded to the Director of Public Prosecutions (DPP) for advice. The Independent Police Oversight Authority (IPOA) is fully independent and has the mandate to investigate any police officer on its volition or on receipt of a complaint from members of the public. Lastly, the Ministry has no vote in its expenditure that can cater for the compensation of the victims. Thank you."
