"content": "Given the sensitivity and the national security implications of currency designs, it is critical that due diligence be undertaken and legal steps be strictly observed. The Governor assures the Senate that a public announcement will be made by the Central Bank of Kenya (CBK) once all the processes are concluded and the new currency is ready to be rolled out. The last question is if the Governor is aware that by continuing to print portraits of an individual on our currency, he is in breach of the Constitution and can lead to his impeachment. Article 262 of the transitional and consequential provisions provides that the transitional and consequential provisions set out in the Sixth Schedule shall take effect on the effective date, to which Article 34 of the Sixth schedule provides that:- “Nothing in Article 231(4) affects the validity of coins and notes before the effective date.” So, as quoted above, the Constitution allows the circulation of the current generation of currencies which at all times remain valid legal tender and to be phased out gradually by the Central Bank. The Central Bank as mandated by law continues to supply bank notes and coins to meet the national demand. Thank you."
