"content": "resources. There has also been a challenge when it comes to exploitation of fisheries resources. For those of us who are in the trade sector--- I know many people may never associate me with the trade sector but I want to tell you that my Master of Law (LLM) which I scored highly with distinction was in the area of trade and investment. Mr. Temporary Speaker, Sir, one of the things that inhibit the exploitation of fisheries in this country is the inability of our nation to achieve the sanitary and vital sanitary standards required globally under the World Trade Organization (WTO) law and the agreement on sanitary and vital-sanitary standards which require that all resources whether in the horticultural or fisheries sectors, achieve required standards of health. That includes the manner in which you are fishing, the place where you are going to store the fish, the fishing nets and the fishing area. There was a time that fish from Kenya was banned from Europe because the European inspectors on matters of sanitary and vital-sanitary standards came to Lake Victoria and found out that the fishing area was not clean or rather not of the required standard. For a long time, the Government had to struggle to ensure that those standards were achieved before our market was again opened in Europe. Mr. Temporary Speaker, Sir, this Bill provides for those standards and enables us to meet our international obligations. If you go to WTO law and particularly the disputes settlements body, many of the conflicts taking place between Europe and China, Europe and the United States, Japan and United States is about how fishing can be done in a sustainable manner. You will find the debate around Article 20 of the guards in terms of sustainability of exploitation of resources and protection of environment and natural resources. Again, this Bill domesticates those international obligations by ensuring that we fight illegal, unreported and unregulated fishing so that states benefit from the fisheries resources within the exclusive economic zones but also do so in a manner that respects the interests of future generations. Mr. Temporary Speaker, Sir, therefore, this Bill from Part I is about the introduction. You have definitions of various terms that are used in the law. Part II is very important because it is about establishment of institutional framework for carrying out exploitation of those resources in a manner that is sustainable. Clause 6 establishes the Kenya Fisheries Advisory Council which will have representation of the Cabinet Secretary for Agriculture, Livestock and Fisheries and the Cabinet Secretary for Interior and Coordination of National Government. This is very important because you are also dealing with the intrusion of national territories by foreign fishermen which has something to do with security. There are matters of transport and infrastructure because of use of fishing equipment that are related to fishing. Mr. Temporary Speaker, Sir, it is important that we have the Cabinet Secretary of Security and Foreign Relations and the Cabinet Secretary of National Treasury. Also, we have a representation of other bodies that deal with fisheries and also a designate from the Council of Governors with expertise in fisheries, who shall be nominated by the Council of Governors. That nominee is one. Maybe going forward, if need be, at the Committee Stage, perhaps, we may need to increase representation of county governments. He should be an expert in matters of fisheries and also it should be a person that comes from the areas that are dealing with fisheries like the coastline, Lake Victoria, Naivasha, Lake Bogoria and Lake Turkana. I think that nomination will also be considered by the Council of Governors. You have also representation from the research institutions in the universities and the institution on consumer protection.
