"content": "their families. About 99 per cent of the cases of aquaculture are commercial. Therefore, to give counties non-commercial aquaculture activities will be to significantly limit their authority. Going further, Part X talks about licenses, authorization and registration. Without going into a lot of details, the Bill says that artisanal vessels shall be registered but this should not be done by the Director General. The principle of subsidiarity should also apply; that artisanal fishing vessels can be registered at the lowest level and not at the level of the Director General. Mr. Temporary Speaker, Sir, the Bill also talks about recreational fishing vessels having to be registered by the Director General. As we went through public participation on this Bill, it was clear that we have not exploited the potential of sport fishing. In the United States of America, we are told that anglers and fly fishers generate more revenue than the National Basketball Association (NBA). Sport fishing generates more revenue in the USA than the NBA. It is for us to find ways of exploiting and making sure that we get that money. I believe that if this was left to the counties rather than the Director General, it could be done in a much better way. Part 18 talks about the establishment of a Fish Marketing Authority. This Authority is established to market fish and fisheries products from Kenya. The Bill is not very explicit on how this authority will be engaged in value addition, value chain and supply chain interventions but I believe that we will be able to expound on that as we process the Bill. Mr. Temporary Speaker, Sir, finally, this Bill is very long. It is a 200 page Bill. When you look at the Constitution, it is 204 pages. You cannot have a Bill that it is longer than the Constitution. What is happening here is that we seem to be mixing up policy, regulation and legislation. I think there is a section on data and information, lots of pages on things that could be captured under policy. I want to urge the Senate that even as we process this Bill, we look at some of these things because 200 pages for a Fisheries Management and Development Bill, the devil will lie in the details and you will find a lot of contradictions. This Bill has been approved by the National Assembly. However, we are the custodians of devolution. I urge fellow Senators that we review the Bill with a fine tooth comb and we ensure that it reflects the spirit of devolution even if it means making fundamental changes to the Bill.
