"content": "It was the assertion of Mr. Olago that arising from the documents tabled, he had established that the High Court Petition No.16 of 2011, was active. Mr. Olago claimed that at the time the Speaker delivered his ruling on 3rd February, 2011, referring the matter of certain constitutional nominations to the Committees of the House, his attention had not been drawn to the ruling of the High Court on the same matter and that the Speakerâs attention now having been drawn to it, it was appropriate that the Speaker determines whether or not it will be proper for the Committees to proceed to consider nominations to those offices in view of the orders of the court. The Chair allowed a number of interventions on the point of order raised by Mr. Olago. Hon. James Orengo, Minister for Lands and the Member for Imenti Central, Mr. Gitobu Imanyara, urged the Speaker to find that the matter was sub-judice while hon. M. Kilonzo, Minister for Justice, National Cohesion and Constitutional Affairs and hon. Amos Kimunya, Minister for Transport, were of the opposite view. The Minister of State for National Heritage and Culture, hon. ole Ntimama, also spoke to the matter. He was concerned at the manner in which the relevant Committees were going about their work, decrying certain statements from Members of those Committees indicating the pursuit of an ethnic and/or partisan agenda. Hon. Members, as I was undertaking to make a ruling on the point of order raised by hon. Olago, hon. George Nyamweya rose on another point of order seeking guidance on whether it was in order for a Member of a Committee to raise in the House an issue which he could raise in the Committee and thereby leaving other Members of the Committee unable to respond or deal with it. I also undertook to give directions on this."
