Temporary Deputy Chairlady, I beg to move:- THAT, Clause 89 of the Bill be amended— (a) in Sub-clause (2) by deleting the words “of not less than five hundred thousand shillings and if the offence is of a continuing nature, to a further fine of not less than fifty thousand for every day or part of a day during which that offence continues or a jail term of not less than six months” and substituting therefor the words “not exceeding one million shillings and if the offence is of a continuing nature, to a further fine not exceeding one hundred thousand shillings for every day or part of a day up to a maximum of thirty days during which that offence continues, or to imprisonment for a term not exceeding twelve months or to both”; (b) in Sub-clause (3) by deleting the words “of not less than five hundred thousand shillings and if the offence is of a continuing nature, to a further fine of not less than one million shillings or a jail term of not less than twelve months or both and substituting therefor the words “not exceeding one million shillings and if the offence is of a continuing nature, to a further fine not exceeding one hundred thousand shillings for every day or part of a day up to a maximum of thirty days during which that offence continues, or imprisonment for a term not exceeding twelve months or to both”. This amendment seeks to enhance the penalties for various offences outlined in this Bill. Clause 89 talks about a fine not less than Kshs500,000. For the same reasons we had agreed on earlier, we want to change to a fine “not exceeding one hundred thousand shillings for every day or part of the day up to a maximum of thirty days during which that offence continues”."
