Temporary Deputy Chairman, I beg to move:- THAT, Clause 43 of the Bill be amended in Sub-clause (4) by deleting the words “of not less than ten million shillings or to a term of imprisonment of not less than two years or both” and substituting thereof the words “not exceeding twenty million shillings or to imprisonment for a term not exceeding ten years or to both”. The reason for the amendment is to align the provision of the sentencing guidelines. This particular clause deals with the oil blocks, somebody who engages in upstream petroleum operations without the licensing and the subsequent penalty for that. A fine of not less than Kshs10 million is ambiguous. It can be anything upward of that figure. Therefore, we want to delete it."
