It is when there is insufficient data in relation to a particular block – where bids have not been received or the received bids do not satisfy certain minimum criteria for execution. Clause 45(4) says:- “Where the Cabinet Secretary intends to negotiate directly with a contractor in accordance with this section, the Cabinet Secretary shall publish a notice of thirty days in the Gazette and in, at least, two newspapers of national circulation.” There is enough transparency and accountability.
