Regarding the fifth question about the assurances that are there that the process of recruitment will be insulated against “dark forces”, there are no dark forces because I believe that the JSC is acting strictly in accordance with our Constitution. We have given the JSC the necessary independence to do that. They have already confirmed by moving with speed to fill the urgent posts that need to be filled. These posts will not be filled as it used to happen by mere consultation with the Attorney-General. Article 172(2)(a) of the Constitution is very clear. Article 172(2) states that:- “ In the performance of its functions, the Commission shall be guided by the following— (a) competitiveness and transparent processes of appointment of judicial officers and other staff of the judiciary.” So, that is going to be followed. Actually, I was a member of the Judicial Service Commission (JSC) when we appointed these very judges. We followed a very transparent process and it was on television---"
