    "content": "have irrigation in the State Department of Water and Irrigation. The Irrigation Department is now under the Department of Agriculture. There is a bit of mismatch. You find that some departments in a ministry are run by different committees of this House. We need to align Committees with the new reorganisation of the Government. The second amendment, which is fundamental, is about the loan Kenya Airways (KQ) is getting. I wish to propose an amendment to the 2015/2016 Financial Year, Second Supplementary Estimates for KQ. This is to reflect an allocation of Kshs20.27 billion under the Public Finance Management (PFM) programme. If you look at Vote R1071 in the Schedule, you will find that it is shown as a loan. This will not lead to any change in the total allocation to the programme. Hon. Members will recall that through the 2015/2016 Estimates No.1 for KQ, appropriation allocation of Kshs20.27 billion was to be paid as loan for on-lending to KQ. The aim of this allocation was to enable KQ to meet its critical and urgent working capital needs. Considering that this is a loan to be borrowed by the Kenya Government for on-lending to KQ for it to meet its critical capital demand, the money must first come to the Consolidated Fund and ultimately loan to KQ as per the financing agreement. If we look at the current Report, we will find that it shows the allocation as Appropriation-In-Aid (AIA) when it is supposed to be paid as loan revenue. Because the Government has guaranteed, the money must come to the Consolidated Fund and ultimately KQ will receive that money. If we do not change it, KQ will not have the benefit of getting this loan financing guaranteed by the GoK. Those are the justifications for those two small amendments. It is the obligation of this House to look at the PFM Act and the Constitution. As of now, the Cabinet Secretary (CS) is operating within the provisions of the law. There is no illegality the CS has committed. But for good public financial management, the CS should not have two Supplementary Estimates in one financial year; he can do better on that. More fundamentally, I think the CS for National Treasury cannot put the House in a crisis mood. Why do you bring a Supplementary Estimate when it is one week to the end of the Financial Year? It took us a while to convince the House Business Committee (HBC) last night to have three sittings today. Once we pass the two Supplementary Reports, the House has an obligation to pass the Appropriation Bill. We only have tomorrow. If that Appropriation Bill is even passed tonight, the President has to sign it into law. That means the CS and the Departments have only 12 hours. That is not fair. We have agreed that I will do a letter to the CS and this will be the last time. Parliament will not be taken for granted. Hon. Deputy Speaker, I beg to move and ask Hon. Amina to second."
