"content": "What the Justice and Legal Affairs Committee is doing contravenes Article 249(2)(b) of the Constitution. The political class cannot sit in the Selection Panel. When you sit in the Selection Panel, what are you doing? You are not sitting there to have a cup of tea. If they sit on behalf of the Opposition, they will make sure that their members are recruited as commissioners. If you sit on behalf of the Government, you are going to influence decisions. That provision proposed by the Justice and Legal Affairs Committee must be amended. There are many other organisations that can sit in the Selection Panel like religious groups. It can have representatives from the Muslim Community, SUPKEM, the National Council of the Churches of Kenya (NCCK), Catholics and from other bodies.
