"content": "This Bill is a linkage with the Constitution on the Basic Education Act 2013. Article 15 of the Constitution provides for the rights of a child, which includes the right to free and compulsory basic education. The Basic Education Act gives effect to that constitutional provision. Therefore, the Bill provides a welcome linkage between the Constitution and the Basic Education Act 2013, to provide an integrated framework for a comprehensive strategy for Early Childhood Development Education (ECDE) that has been missing. There is provision for the involvement of the county governments in education in the Fourth Schedule of our Constitution. This Schedule addresses distribution of functions between the national Government and the counties. One of the functions assigned to the county governments is the management of free primary education and child facilities. Therefore, the Bill provides locus for the involvement of the county governments in fulfilling their constitutional obligation.
