Remember, we never sought review of the Supreme Court decision; it is already there as a progressive requirement according to the Supreme Court thinking. Now, how do we deal with it? Even as we speak – and Hon. Alice Wahome will tell you - so few within this Parliament have read that Supreme Court decision. One person says, “Let us put it in the Constitution so that it is a constant reminder.” How can it be taken away? We need to deal with the realization of the gender principle in legislation because it gives us the flexibility that a constitutional amendment or the requirement for it does not give us.
