"content": "Hon. Temporary Deputy Chairlady, Clause 14 was an amendment by deletion. It seeks to delete a clause that amends Section 42 of the Act on the processing of the Division of Revenue Bill and County Allocation of Revenue Bill. Looking at Articles 228(5) and 249(2) (b) of the Constitution, it suffices to give direction on how the Office of the Controller of Budget should go about performing its constitutional mandate. Therefore, there is no need for written instructions from the National Treasury directing the Controller of Budget to approve withdrawals for transfer to counties in the event that the Division of Revenue and County Allocation of Revenue Bills have not been enacted. Also, timelines can be rescheduled as well as robust enforcement to deal with the possibility of any foreseeable failure to enact the Division of Revenue Bill and the County Allocation of Revenue Bill."
