Members, in a presidential system of Government like the one obtaining in Kenya, a strict interpretation of the meaning of the doctrine of separation of powers is necessary for the preservation of democracy and the rule of law. Such an interpretation leads to the inevitable conclusion that none of the three arms of the Government of Kenya may exercise power conferred on the other, nor should any person be a member of more than one of the arms. Indeed, separation of powers is meant to establish a system of checks and balances between the branches of Government."
