"content": " Thank you, Hon. Deputy Speaker. My name is Gikaria David, the Member for Nakuru Town East Constituency. I take this opportunity to thank the great people of Nakuru Town East for giving me a second opportunity to represent them in this House. Let me also congratulate you for being elected unopposed as the Deputy Speaker. First, we have been in this Parliament, in the 11th Parliament, and we have heard great speeches from the President, yet again when he came here the other day, it was one of the best. It actually superseded the others. When you look at Article 10 of our Constitution, exactly what is said under the values and principles provisions, I think that is exactly what he said. I will start with what we are seeing in the Judiciary. Here in Parliament, if you have to pass a very critical Bill or Motion, you must get two-thirds approval. Not two-thirds of those sitting; it is two-thirds. It has a number. It so unfair that the Judiciary…. When I was doing my calculations, four people out of seven are 57 per cent. I think it is high time we started looking at the critical aspect of having a law to say that the Supreme Court cannot make such a crucial decision if they are not two-thirds or so. People are now starting to say Jubilee is trying to start amending laws. We are not going to gag the Judiciary, but we are going to ask Parliament to start thinking of how we can do some amendments. Look at Article 141(1) of the Constitution. It says: “The swearing in of the president-elect shall be in public, before the Chief Justice, or, in the absence of the Chief Justice, the Deputy Chief Justice.” I want to believe that the Judiciary was invited to the State opening of Parliament. They skipped it. It was by design. Looking at the proceedings at the Supreme Court, if you look at the four, they were the only ones who were asking so many questions. You could tell by their body language what was going to come. It is very unfortunate that actually that is what came. So the question we are asking is: If the CJ and his team were invited and they did not show up, will they also skip if our President is elected on 17th and they are the same people who are supposed to swear him in? These are some of the issues we need to critically look at. We hope that the CJ, by the Constitution, is supposed to swear in the President. So if he does not come and the DCJ also does not come, what happens? These are some of the issues. Secondly, we in Nakuru have made a decision that come 17th, if the people make a decision, we are not going to allow the same people to again sit and take away what we have already decided. We are tired of what is happening. We want to tell the Opposition to take note. We are not going to allow you to continue with what you are doing. Thank you, Hon. Deputy Speaker.
