    "content": "Thank you, Hon. Temporary Deputy Speaker, for giving me this opportunity to support the Copyright (Amendment) Bill, 2017 that seeks to amend the Copyright Act, 2001. As you are all aware, we have a new Constitution and it was important that we align the 2001 Act to the new Constitution. I think it is important that we all know what it is that the 2010 Constitution provides for. We all know that the Constitution has one of the most supportive Bill of Rights to the people of this country. Article 11(2) says: “The State shall— (a) promote all forms of national and cultural expression through literature, the arts, traditional celebrations, science, communication, information, mass media, publications, libraries and other cultural heritage. (b) recognise the role of science and indigenous technologies in the development of the nation; and (c) promote the intellectual property rights of the people of Kenya.” Out of these provisions of Article 11 of the Constitution, there is certainly need for us to ensure that these rights are properly taken care of in law, so that we can protect the intellectual capacity and property of our citizens. “Further, Article 40(5) says: The State shall support, promote and protect the intellectual property rights of the people of Kenya.” Therefore, there is need for us to have legislation that will ensure that, that does happen. The same Constitution continues to say, in Article 69(1): “The State shall— (c) protect and enhance intellectual property in, and indigenous knowledge of, biodiversity and the genetic resources of the communities; The electronic version of the Official Hansard Report is for information purposesonly.
