"content": "(Sen. Murkomen): Madam Temporary Chairperson, I have an amendment to Clause 15. I beg to move:- THAT, the Bill be amended by deleting Clause 15 and substituting therefor the following new clause- Amendment 15. Section 45 of the principal Act is amended- of section (a) in subsection (1) by deleting the introductory clause and 45 of No. substituting therefor the following new clause- 17 of 2012. Whenever a vacancy arises in the office of a county chief officer, the respective governor shall within fourteen days- (b) by deleting subsection (6) and substituting therefor the following subsection- (6) The office of the county chief officer shall become vacant if the officer- (a) dies; (b) resigns by notice in writing addressed to the governor; or (c) is removed from office in accordance with the terms of service or any other written law applicable to the officer. There has been a situation where in many counties the office of the chief officer has been left unattended yet it is very important, constitutionally, in pursuing the accountability in the counties. In some counties it has been left vacant deliberately to facilitate confusion. The office of the chief officer should not be indefinitely vacant. The county government should be given at least 45 days within which the position should be filled. They need 45 days because there will be advertisement, interviews and vetting which involves public participation. So, 45 days should be enough for purposes of filling that vacancy. The second part implies that when a new governor takes office and wants to do away with the chief officers, or a situation of death or resignation arises, that office should be filled within 45 days.
