Murkomen): Madam Temporary Chairperson, I beg to move:- THAT Clause 17 of the Bill be amended in the proposed new section 58A by deleting – (a) subsection (1) and substituting therefor the following new subsection- (1) Whenever a vacancy arises in a county public service board, the governor shall nominate and, with the approval of the County Assembly, appoint members to a selection panel for the purpose of selecting suitable candidates for appointment as members of the county public service board. (b) subsection (2) and substituting therefor the following new subsection- (2) The selection panel under subsection (1) shall consist of the following persons - (a) a chairperson, not being a public officer; (b) one person from the private sector; (c) an Advocate of the High Court of Kenya, who is a member of the Law Society of Kenya; (d) an accountant who is a member of the Institute of Certified Public Accountants of Kenya; and (e) one person from an association representing workers. (2A) The governor shall, in nominating members to the selection panel, ensure that not more than two-thirds of the nominees are of the same gender. I was the Mover of the Bill. If you look at the original amendment, I had proposed that we need a selection panel of a representative from the Law Society of Kenya (LSK), the Institute of Certified Public Accountants of Kenya (ICPAK) and the Federation of Kenya Employers (FKE). However, we realized later that it would create chaos in the devolution sector because it was going to create centralization of people to be appointed, who are not even going to serve because they are just a selection panel. To correct that anomaly, we will still allow the governor to appoint a selection panel but he must appoint an advocate, a certified accountant and someone who is representing the interest of workers. The list of his appointees must be approved by the county assembly. That will do away with the bureaucracy but achieve the independence required to get qualified people to sit in the selection panel."
