"content": "The other area which we need to look at is the establishment of the Energy Regulatory Commission (ERC). If you create many energy regulatory authorities, it makes it very difficult if you want to operate a business. Where will you get your licence from? We have also taken care of the role of the county governments in this Bill. The Fourth Schedule of the Constitution gives the county governments powers to regulate gas and electricity. We are making a law for posterity. This means that in future, we will have gas in one area which will be distributed in the houses within a town. This is the constitutional mandate of the county governments. They should look at it and regulate how that will be done. When you want to do business like opening a petrol station, you must meet the health standards. We have provided in this law that you must have the business premise licence from the county government, so that they understand the kind of business you are doing within that place and the safety of the people surrounding. The county governments presented their memorandum which we looked at vis-a-vis the Constitution. We have provided whatever is constitutionally mandated to them. We have also provided what is required for national Government, especially for the Cabinet Secretary in terms of making policy standards and carrying out the guidelines in oil exploration, development and production."
