    "content": "Hon. Chairman, I beg to move: THAT, Clause 8 be amended by deleting sub-clause (3). Members, if you use the Order Paper without the Bill, you will get confused. So, it is good to have those two. I am sure Hon. (Dr.) Nyikal knows that. What I am deleting is on the powers and functions of the Authority. The creation of the Suthority is found in Section 7(1) and it is to provide for a public institution to deliver the object and the purpose of this Act. Section 8(3) creates an ambiguous arrangement without due structures and upon which oversight cannot be guaranteed outside the confines of Article 6(3) of the Constitution of Kenya. What I am deleting is saying that the Authority shall exercise its various powers and functions under the section primarily through the mechanism of agency contracts. All those are found in section 8(1). It is ambiguous. I do not feel it has any power. I propose that we delete it. I am sure the Chairman will agree with me."
