Clause 19(7)(e) states- “The chief executive officer may be removed from office on the recommendation of the Board if the chief executive officer- (e) conducts himself in a manner deemed to be inconsistent with this Act.” I am proposing an amendment to include Retirement Benefits Authority (RBA) Act. Clause 19(8)(b) says- “Before the chief executive officer is removed under subsection (7), the Board shall give the chief executive officer- (b) an opportunity to be heard either in person or by a legal representative”. This needs to be checked against the Employment Act because legal representative normally comes after the internal process is complete. So, in my view, this needs to be harmonised."
