This is because if we have passed Clause 48 and for almost similar offences, if you are going to either sentence someone to Kshs5 million fine or two years imprisonment or both, then it should follow under Clause 49 that the same sentence of Kshs5 million and two years imprisonment should apply. So, we do away with Kshs500,000 and three years imprisonment."
