They need some form of protection so that they are not seen as standing in between the children and the inheritance when they are alive but they should be seen as useful and important members. There is a provision that a person who is convicted of an offence under this Act for which no penalty is provided shall be liable to a fine not exceeding Kshs1 million, or imprisonment for a term not exceeding two years, or both. There is some discretion that can be applied through regulations by the Cabinet Secretary for better carrying out of the provisions of the Bill, which I hope this House will pass. The final part is transitional provisions on existing homes. There are many homes that are registered but without a framework. Therefore, they are not able to operate with equal standards and provide certain things. Some are even doing the wrong things to the older persons. So, all of them will need to be registered after having passed the criteria that is provided for in the law. The registration will be done by the county governments. I believe that this Bill will greatly improve the lives of older members of the society. I encourage Members to have a look at the Report of the Committee and also talk to Sen. Cheruiyot who is the Sponsor of this Bill and was inspired to bring such legislation before the House. You will also find in Part IV of the Report the recommended amendments by the Committee. We have 16 amendments but I am sure Sen. Cheruiyot will agree that they are necessary for this Bill to be implemented. With those many remarks, I thank you, Mr. Speaker, Sir."
