"content": "so that Parliament is not set up as an alternative judicial forum to a court which could lead to a conflict between a House of Parliament and the courts. Traditionally, the Convention was applicable when cases were determined by the laymen or non-lawyers in form of juries. However, over time, the doctrine has been narrowed in light of the supremacy of the Constitution, human rights guaranteed in the Constitution and the fact that Kenya does not have a jury system. Hon. Senators, our criminal justice system is underpinned by the right to fair trial as set out in Article 50 of the Constitution which includes the presumption of innocence which was raised yesterday.
