Temporary Deputy Chairman, I stand to oppose the amendment because the essence of arbitration is to get an independent party to arbitrate or resolve a dispute between two contracting parties. The Cabinet Secretary sits on the board of the Kenya Post Office Savings Bank. Consequently, being consulted before an arbitrator is appointed is to disadvantage the client who has got a contractual issue against the bank. This is setting a dangerous precedent because what it means is that an arbitrator who is not independent or who is impartial will not be selected."
