Temporary Deputy Chairman, I beg to move: THAT, the Schedule to the Bill be amended in the proposed amendments to the Nairobi Centre for International Arbitration Act by - (a) deleting the proposed amendments to section 6(1) and substituting therefor the following— S.6(1) Delete the word “justice” appearing in paragraph (c) and substitute therefor the word “finance”. Insert the words “Kenya Branch” immediately after the word “Arbitrators” appearing in subparagraph (iv) of paragraph (f). The rationale here is that the Committee recommends that the proposed amendments to Section 6(1)(e) be rejected. The reason is that the proposed amendments under (e) on the reduction of the member-States to represent the domestic bodies for arbitration in East Africa from five to three will create a problem because the East African Community (EAC) has more than three member-States. The Committee resolves to retain the number of five. The amendment intended to reduce the number from five to three. That will be a problem because we have more than three member-States in the EAC. That is the basis for our rejecting that amendment."
