"content": "I heard him mention Article 255 of the Constitution; that, we are trying to change the composition of Parliament, hence the unconstitutionality of what we are trying to do arises from the fact that it requires a referendum. I want to look at the provisions of Article 255 of the Constitution. I want to read it for the good lawyer to advise me later over a cup of tea. Article 255 of the Constitution says that a referendum is required if the amendment relates to any of the following matters: Supremacy of this Constitution, the territory of Kenya, sovereignty of the people, the national values and principles of governance referred to in Article 10 (2) (a) to (d), the Bill of Rights, the term of office of the President, the independence of the Judiciary and the commission and independent offices to which Chapter 15 applies, and the functions of Parliament. I have not seen the composition of Parliament. I do not see anywhere the Bill before us is interfering with the functions of Parliament. Further, the objects, principles and structure of devolved government. The structure that is spoken to here is of devolved government. Again, I do not see where that is affected by Hon. Dualeās Bill."
