A warehouse operator, or any officer, agent, or employee of a warehouse fraudulent operator, who issues or aids in issuing a receipt knowing the goods for which such receipt is warehouse receipts. issued have not been actually received by such warehouse operator, or are not under his actual control at the time of issuing such receipt, commits an offence and is liable on conviction to a term of imprisonment not exceeding ten years or a fine not exceeding ten million Kenya shillings, or to both."
