"content": "quite wrongly, that there is a procedure in the Constitution about how the two Speakers can determine a matter concerning counties. That is not in the Constitution. The drafters of this Constitution for some reason envisioned that the people who would sit at the Chair, where you are, would be a man or woman who would not need step by step guidelines as to what concerns counties. Therefore, it has come to the fore that this matter has become very urgent for purposes of guiding this House. This is because all of us are drafting Bills and we have a legal team which is paid by the PSC. At the end of drafting a Bill we state whether a matter concerns counties or not. We spend a lot of time drafting these Bills. However, for some reasons, at the tail end of these Bills and after a lot of work has been put in by these Senators who are not idle, when it goes to the National Assembly, they become money Bills under Article 114. Mr. Deputy Speaker, Sir, lastly, this matter was also interrogated by the Supreme Court. As you go ahead and issue that direction, allow me for avoidance of doubt to read the Supreme Court Advisory Opinion Reference 2 of 2013, paragraph 102 which states as follows:- “This is a very broad definition which creates room for the Senate to participate in the passing of Bills---"
