"content": "The Independent Electoral and Boundaries Commission (IEBC) published a public notice prescribing the minimum qualifications, one of them being that one must not hold dual citizenship. The appellant filed a petition in the High Court seeking a declaration to quash the notice. The learned judge of the High Court felt that by virtue of Article 78(2) of the Constitution, a person who holds dual citizenship cannot run for an elective office as a Member of Parliament. Having been dissatisfied with that decision of the High Court, the appellant appealed to the Court of Appeal which held as follows:"
