"content": "Data protection Impact assessment 16A. (1) Where processing of personal data is likely to result in high risk to the rights and freedoms of a data subject due to the nature, scope, context or purpose, a data controller or data processor shall, prior to processing, carry out an impact assessment. (2) The impact assessment shall include – (a) a systematic description of the intended personal data processing operations and the purpose for processing; (b) an assessment of the necessity and proportionality of personal data processing operations taking into account the purposes for processing of personal data; (c) an assessment of the risks to the rights and freedoms of a data subjects; and (d) the measures envisaged to address the risks, including safeguards, security measures and mechanisms to ensure the protection of personal data and to demonstrate compliance with this Act, taking into account the rights and legitimate interests of data subjects and other interested persons. (2) Where an impact assessment indicate that the processing of personal data would result in high risk to the rights and freedoms of a data subject, a data controller or data processor shall consult the Commission prior to processing personal data. (3) The Commission shall set out the guidelines for carrying out an impact assessment under this section."
