    "content": "This Statement has been requested under Standing Order No. 47 under which no provision is made for comments or observations. However, I did exercise my discretion and applied Standing Order No.1 which is an overriding Standing Order because I understand that over the last few years, the issue of betting and gambling has taken over the psyche of our nation. There have been concerns, which I believe are legitimate, about the serious socio- economic and cultural ramifications of betting and gambling. From the Statement made by Sen. Malalah, the Senator for Kakamega County, and the comments and observations that have been made, there is concern on the power and role of the national Government as provided for in the Constitution but in the context of this House, we are also concerned of how that plays out with the role of our counties. There has been a lot of push and pull around that issue. Therefore, it is my own view that we have had many negative socio-economic effects on betting and gambling and they must be balanced from a legal standpoint with the constitutional dictates and parameters within which the Government must regulate business. For that reason, although the subject matter of betting and casinos relates to issues of a social nature and would ordinarily fall into the mandate of the Committee on Labour and Social Welfare, I find that the overwhelming majority of the issues raised by Sen. Malalah’s Statements and the comments and observations that have ensued thereafter, raise legal issues. Accordingly, I direct that this Statement be conveyed to the Committee on Justice, Legal Affairs and Human Rights with a view to not only consider the matter in The electronic version of the Senate Hansard Report is for information purposesonly.
