(e) in the proposed new section 3D by deleting subsection (2) and substituting therefor the following new subsection— (2) Where the National or county government has in place a medical scheme, the National and county governments shall, in implementing the scheme, take in to account the needs of persons with mental illness and shall ensure that the implementation of the scheme results in the fair treatment of such persons.
