"content": " Thank you, Hon. Temporary Deputy Speaker. I second the Motion that this House adopts the Report of the Committee to annul Section 18 of the Political Parties (Funding) Regulations, 2019. We had quite a number of reports and out of the four, we are proposing to annul three. I can remember one time we were in a Committee meeting and a Chair of a Committee, which I do not wish to name, said that this seems to be an annulling Committee. He was especially shocked by our use of the words “annul in its entirety”. This is because we are guided by the law. The fact remains that even the Statutory Instruments Act that we use gives any regulation making authority opportunity to consult with the Committee before they publish any regulations. We face problems with regulation making authorities since every Act of Parliament seems to identify them and give them powers to make regulations. Whenever they get the powers, they decide to make regulations without following the Statutory Instruments Act, which must be followed. I would like to advise that they consider pre-publication scrutiny. They should do a draft and before they publish in the Kenya Gazette, they should sit with the Committee. This is the requirement of the Statutory Instruments Act. I would like to point out something because I know these authorities would like to refer to it even those that we have annulled.
