Temporary Deputy Chairman, I beg to move: THAT, Clause 48 of the Bill be amended by─ (a) deleting the item “(1)” appearing immediately before the words “a data controller”; (b) deleting paragraph (b) and substituting therefor the following new paragraph─ “(b) the data controller or data processor has given proof to the Data Commissioner of the appropriate safeguards with respect to the security and protection of personal data, and the appropriate safeguards including jurisdictions with commensurate data protection laws;” Hon. Temporary Deputy Chair, we are proposing this amendment to ensure that we make it very clear in the law as well as to set out jurisdictions with commensurate data protection laws during trans-border or transfer of data out of Kenya. This is basically for the Data Commissioner to ensure that there is security and safeguards for transferable data. I beg to move."
