"content": "In Clause 40(2), we need to add the word “sex” to discrimination because we are increasingly realising that we have children who are intersex who have been excluded. These are children who have two genitalia, both male and female. I was recently talking to some of them as part of the Parliamentarians for Global Action Kenya and what was evident is that when a child who presents two genitalia goes to school, the teachers do not know how to classify them. They do not know which toilet to go to and they get a lot of discrimination. One of them was sharing with us that they had to be undressed in public. So, the public was asking them whether they are male or female. At that level, we need to recognise that there are children who may have those characteristics."
