Senators, the Court has upheld our legislative role and this House is now called upon to rise to the challenge and discharge its mandate under the Constitution without fear or favour. We must ensure that the Division of Revenue is enacted every year with sufficient funds for counties and in a timely manner. It is important for the Senate to immediately commence the process of enacting legislation that addresses situations where there is an impasse between the National Assembly and the Senate on the division of revenue. The Supreme Court has urged the two Speakers of the Houses of Parliament to initiate requisite legislative action so as to entrench the Supreme Court’s Advisory Opinion on what happens in the event that there is an impasse in the passage of the annual Division of Revenue Act. This is a matter of grave public interest. It is a matter this House must expedite to avoid a situation such as the one that prevailed in the last financial year. The financial year began without Parliament having built consensus on the Division of Revenue Act. We must comprehensively address the question of how counties can access funds, in the intervening period, where Parliament is yet to pass the annual Division of Revenue Act.
