"content": "Further, if the National Assembly attempts or does enact the Appropriation Act before there is in place a Division of Revenue Act, the resulting Act would be unconstitutional. This is a question that we have repeatedly raised. Appropriation must be based on the National Government’s share of equitable revenue, contained in the Division of Revenue Act. Appropriation at both levels of Government must be based on the vertical allocation of equitable share of revenue between the two levels of government and the horizontal allocation amongst the counties. The Supreme Court has affirmed that this is the role that the Senate must guard and protect zealously. At this point, let me reiterate that this House is directly elected by the people and represents the sovereignty of the people pursuant to Article 1 of the Constitution. The Constitution and the Supreme Court have affirmed the crucial role that this House plays in the constitutional dispensation that the people of this country overwhelmingly voted for.
