"content": " Mr. Speaker, Sir, I beg to reply. The rates mentioned in the Question of 22 per cent and 10 per cent for the allocation of the Fuel Levy Funds to constituencies became effective in December, 2009 following the enactment of the Kenya Roads Act, 2007. The budgeting process for the fuel levy was completed before the commencement of the Financial Year 2009/2010 and prior to the amendment of the Kenya Roads Board Act by the Finance Act of December, 2009. Thereafter, the Board in accordance with the Kenya Roads Board Act of 1999 as amended by the Kenya Roads Act, 2007, allocated funds for constituencies and districts as follows: 1. Twenty percent of the monies from the Fund allocated equally to all constituencies in the country to be administered by the Kenya Rural Roads Authority (KeRRA). 2. Twelve percent of the monies from the Fund to be allocated equitably to districts in respect of rural roads administered by the Kenya Roads Authority. The portion of 12 per cent for the districts had been released by December, 2009 to address the critical challenges of road maintenance following the rains.
